Drug trafficking is very misleading and results in much confusion for the accused.  To be arrested, charged and even convicted under this criminal statute the prosecution does not need to prove the individual is a high-level dealer or even an occasional small time dealer.  Trafficking is presumed based on the weight of the illegal drug or the amount of plants in possession of the defendant. 

In years past, airports were generally targeted, specifically patrons who purchased one-way tickets and paid cash.  Now, delivery couriers inspect packages and will notify law enforcement if the package in their possession, who in turn wear the uniform and deliver the package.  The individual who signs for the package and the addressed recipient will generally get arrested and charged. 

The statute has come under criticism, even from Judges, in its strict interpretation.  Some prescription narcotics qualify for trafficking, because the entire pill is weighed, not just the "controlled substance".  Many people addicted to vicodin and other drugs, are charged under this statute based on the contents of one pill bottle.  The penalties are strict and harsh.  Mandatory prison sentences ranging from 3 years to Life and monetary penalties starting at $25,000.00 are the minimums created by the legislature.  It is important to hire an attorney early on in these cases so a full and thorough investigation is completed.  We have helped clients get charges reduced by viewing the evidence and pointing out the inaccuracies in the police reports.
